On November 14, 2011 a new rule will take effect requiring most private-sector employers to post a notice to employees regarding their rights under the National Labor Relations Act. In brief, the notice states that employees have the right to act together to improve wages and working conditions, to form, join and assist a union, to bargain collectively with their employer, and to refrain from any of these activities. It provides examples of unlawful employer and union conduct and instructs employees how to contact the NLRB with questions or complaints. The employee notice must be posted in conspicuous places where they are readily seen by employees, including all places where notices to employees concerning personnel rules or policies are customarily posted. If such notices are also made available electronically, the same must be done with this posting. The free 11×17 poster will be made available for download at the NLRB website at www.nlrb.gov or available in the NLRB’s regional offices. Where 20 percent or more of an employer’s workforce is not proficient in English and speaks a language other than English, the employer must post the notice in the language employees speak. Translated versions of the notice will also be made available at no cost to employers.
